Scope of application (1) These General Terms and Conditions (GTC) apply to contracts with the State of Baden-Württemberg, represented by the State Ministry of Baden-Württemberg (hereinafter referred to as StM), for the online dispatch of free and paid advertising materials of the international umbrella brand campaign "THE LÄND". StM does not recognize any deviating terms and conditions of the Customer. This also applies if we do not expressly object to their inclusion. (2) StM uses the services of Atlas Service GmbH, owned by Ralph Liermann and Isabel Ludwig, to process orders. (3) The StM sells its own goods and, if applicable, goods on commission via the online store. (4) StM generally delivers to addresses within the Federal Republic of Germany and to other EU countries. A delivery to other states abroad can be possible after individual inquiry. (5) These GTC apply accordingly to the purchase of vouchers, if and insofar as nothing to the contrary is expressly regulated. 2. Offer and conclusion of contract The product offer of the online store does not constitute a contract offer by StM. By clicking the order button "order with costs" in the online store, the customer places a binding order for the goods in his shopping cart. You will receive an automatically generated confirmation of receipt of the order. A contract is not yet concluded by the confirmation of receipt. A contract is concluded only with the dispatch of the goods or by an order confirmation (within three working days at the latest). If the delivery of the goods ordered by you is not possible, for example because the corresponding goods are not in stock, we refrain from a declaration of acceptance. In this case a contract is not concluded. The dispatch of the goods is carried out by the company Atlas Service GmbH on behalf of StM. 3. Cancellation policy, right of withdrawal If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you shall have a right of revocation in accordance with the statutory provisions. You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods. If you make use of this option, we will immediately send you (e.g. by e-mail) a confirmation of receipt of such revocation. To comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.
Consequences of revocation
If the contract is revoked, we shall reimburse you all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which the We will use the same payment method for this repayment. The right of withdrawal does not apply to commercial customers. 5. Prices and shipping costs (1) All prices in our online store are gross prices including the statutory value-added tax and are exclusive of any applicable flat-rate shipping costs. (2) The order quantity of free products is limited depending on the product type. Larger quantities can only be provided upon request. The decision on this will be made individually. For the delivery of free items within Germany, the StM shall bear the shipping costs. (3) When ordering merchandising items for which a charge is made, the customer shall pay a flat-rate shipping fee in addition to the purchase price. This includes postage, packaging material and a handling fee and amounts to € 0.00, € 2.90 or € 4.90 within Germany, depending on the item.
6. Payment methods and conditions (1) The purchase price is due upon receipt of the order confirmation by the customer. (2) Payment shall be made in advance or via PayPal. The order confirmation contains the information required for a transfer of the invoice amount. In the case of payment by "PayPal", payment shall be processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. For this purpose, the terms of use of PayPal apply. These can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. (3) The order confirmation serves as an invoice for the product and/or shipping costs in the case of items that are free of shipping costs. 7. Redemption of campaign vouchers
(1) Vouchers which StM issues free of charge as part of (promotional) campaigns with a specific period of validity and which the Customer cannot purchase ("promotional vouchers") can only be redeemed in the Seller's online store and only during the period specified by the Seller.
(2) Promotion Vouchers can only be redeemed by consumers.
(3) Individual products may be excluded from the voucher promotion. The specific restrictions, if any, can be found on the promotional voucher.
(4) Promotion vouchers can only be redeemed before the order process is completed. There will be no subsequent offsetting.
(5) Only one promotional voucher can be redeemed per order. The redemption of several promotional vouchers in one order is not possible.
(6) The value of the goods of the respective order must be at least the amount of the promotional voucher. Any remaining credit will not be refunded by the seller.
(7) If the value of a promotional voucher is not sufficient to pay for the respective order, one of the other payment methods offered can be used to settle the difference.
(8) The credit balance of a promotional voucher is neither paid out nor does it earn interest.
(9) The promotional voucher will also not be refunded if the customer returns the goods paid for in full or in part with the promotional voucher within the scope of his statutory right of revocation.
(10) Promotion vouchers are generally transferable. 8. Delivery conditions and transfer of risk (1) Unless a different delivery address is specified, the invoice address shall be the delivery address. (2) We are entitled to make partial deliveries as far as this is reasonable for you. (3) For delivery to non-EU countries, the shipping costs are agreed individually.
(4) If the customer is an entrepreneur, the delivery of the goods is at his risk. (5) Depending on postal and parcel delivery services, delivery will be made within approx. 7 to 10 working days after receipt of payment unless otherwise agreed. For orders of larger quantities, the delivery time is approx. 10 to 14 days. (6) Shipping by Atlas Service GmbH, Breitwiesenstr. 9, 70565 Stuttgart, shall be effected via MB Mail / Deutsche Post for letters or DHL for packages.
9. Warranty for defects For all goods from the online store of the international umbrella brand campaign, the legal warranty rights apply.
10. Retention of title (1) The delivered goods remain the property of the StM or, in the case of commission goods, the property of the principal until payment has been made in full. (2) Insofar as StM exchanges goods within the scope of claims for defects, the transfer of ownership of the subsequently delivered goods shall take place under the condition precedent that the customer returns the goods to be exchanged or - insofar as he is unable to do so - pays compensation for the value if the legal requirements are met. 11. Place of performance, place of jurisdiction
For legal disputes with merchants, legal entities under public law, special funds under public law and persons without a general place of jurisdiction in Germany arising from contracts for the online dispatch of goods, Stuttgart is the exclusive place of jurisdiction. 12. Severability clause Should one of the provisions of these GTC be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
13. Online dispute resolution
The European Commission provides a platform for online dispute resolution at http://ec.europa.eu/consumers/odr/. The StM is not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
14. Data protection (1) Personal data will only be collected, processed and used if the customer has consented or if the Federal Data Protection Act or another legal provision directs or permits it. (2) The data required for the business transaction will be stored and passed on to commissioned service providers for order processing to the extent necessary. (3) The data entered will be transmitted in encrypted form using the SSL procedure (certificate).
15. Miscellaneous (1) Changes, additions and the cancellation of contracts for online shipping must be in writing. (2) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you have placed the order as a consumer and have your habitual residence in another country at the time of your order, the application of mandatory legal provisions of this country shall remain unaffected by the choice of law made in the preceding sentence.
